This Consumer Health Data Privacy Policy is provided pursuant to the Washington My Health My Data Act (MHMDA), RCW 19.373, and is separate and distinct from the general Privacy Policy available on this website. It applies specifically to consumer health data — a category the MHMDA defines broadly to include any personal information that identifies or is reasonably linkable to a Washington resident and that relates to their physical or mental health condition, health care services sought or received, or related inferences.

If you contact this website for the purpose of inquiring about mental health services, the information you share may qualify as consumer health data under this definition. This policy explains how that information is handled.

What Consumer Health Data This Website May Collect

When you use the contact form, request a free consultation, or otherwise communicate through erinriggiocounseling.com, you may voluntarily share information that constitutes consumer health data, including:

  • The fact that you are seeking mental health counseling or therapy

  • Information about symptoms, concerns, or conditions you choose to describe

  • Information about prior treatment or medications, if you include this in your message

  • Any other health-related details you voluntarily provide

By submitting a contact form that includes health-related information, you are providing consent for that information to be used to respond to your request.

You may withdraw your consent at any time by contacting erin@erinriggiocounseling.com. Withdrawal of consent does not affect any actions taken before the withdrawal.

Sharing of Consumer Health Data

Consumer health data is not sold or shared for commercial purposes. It may be accessed in limited circumstances by the following categories of parties:

  • Squarespace, Inc. (website hosting and form processing) — 225 Varick Street, 12th Floor, New York, NY 10014 | privacy@squarespace.com. Squarespace processes data as a data processor under a binding Data Processing Agreement that limits its use of your data.

  • Legal authorities, if disclosure is required by law, court order, or valid legal process.

  • Emergency or safety personnel, if there is a credible risk of imminent harm to you or another person, as may be required under Washington State law.

No consumer health data is shared with any other third party, affiliate, or data broker.

Your Rights Under the MHMDA

As a Washington State resident, you have the following rights with respect to your consumer health data:

Right to Confirm and Access. You may request confirmation of whether consumer health data has been collected about you, and receive a copy of that data. Upon request, you will also receive a list of all third parties and specific affiliates to whom your consumer health data has been disclosed, along with their contact information.

Right to Withdraw Consent. You may withdraw consent for the collection or sharing of your consumer health data at any time. To withdraw consent, contact erin@erinriggiocounseling.com. Withdrawal is effective going forward and does not affect prior lawful processing.

Right to Deletion. You may request that your consumer health data be deleted. Upon receipt of a verifiable request, your data will be deleted within 30 days unless retention is required by law.

Right to Non-Discrimination. You will not be penalized, denied services, or treated differently for exercising any rights under this policy or the MHMDA.

Appeals Process

If I decline to take action on your rights request, you have the right to appeal. To do so, email erin@erinriggiocounseling.com with the subject line "MHMDA Appeal" and a description of your original request and my response. I will respond in writing within 45 days, as required by the MHMDA.

If you remain unsatisfied after appeal, you may file a complaint with the Washington State Attorney General's Office:

Data Retention

Consumer health data collected through this website is retained only as long as necessary to fulfill the purpose for which it was collected, and no longer than 24 months. After that period, it is securely deleted. You may request earlier deletion at any time (see Your Rights above).

Important Distinction: Clinical Records

This policy governs only consumer health data collected through this website prior to or outside of a formal therapist-client relationship. Once a therapeutic relationship is established, your clinical health information is protected health information (PHI) under HIPAA and health care information under Washington's Uniform Health Care Information Act (RCW 70.02). Those records are governed by the HIPAA Notice of Privacy Practices you will receive at intake — not this policy.

Changes to This Policy

If this policy is updated, the "Last Updated" date above will reflect the change. For material changes, reasonable efforts will be made to provide direct notice. This policy may not be modified to reduce your rights under the MHMDA without the notice required by law.
